Bengies Awarded $838,000 In Circuit Court Suit

The drive-in theater sued a nearby Royal Farms, saying the outdoor lighting was detrimental to the business.

A Baltimore County Circuit Court jury awarded Bengie's Drive-In $838,000 in a decision Friday morning in a lawsuit the drive-in theatre filed against a nearby Royal Farms store.

The Baltimore Sun reported Saturday that the jury found that the outdoor lighting at the convenience store was detrimental to the drive-in's operation.

The jury deliberated nearly four hours on Thursday and Friday after the case began last Monday, the Sun reported.

Bengies owner Ed Vogel told the Sun that the decision bodes well for the future of the drive-in, but that he would not celebrate until it was certain the decision would not be overturned on appeal.

"I don't see what the next obstacle could be," Vogel told the Sun. "It makes our future look a little brighter."

An attorney representing the convenience store told the Sun that an appeal would be forthcoming.
